A seasoned litigator with nearly two decades of experience across New York and Florida, Andres represents medium-sized businesses in their most consequential legal battles: business disputes, employment claims, and intellectual property conflicts.  He brings a rare combination of courtroom experience and business-owner perspective to every matter – the kind of judgment that comes from having sat on both sides of the table.

Andres’s practice centers on three areas where businesses face their greatest litigation exposure:

   Business/Commercial Disputes. From breach of contract and partnership conflicts to fraud claims, fiduciary duty breaches, and shareholder disputes, Andres handles the full spectrum of business-to-business and intra-company litigation. He knows how to move fast when circumstances demand it and how to play the long game when strategy requires it.

   Employment Litigation. Andres defends and prosecutes employment claims, with a focus on discrimination and retaliation matters and non-compete / restrictive covenant disputes.

   Intellectual Property Disputes. Andres protects the brands and creative assets that give businesses their competitive edge, handling trademark infringement and enforcement actions as well as copyright matters in state and federal court.

Andres also advises clients on the front end, identifying legal vulnerabilities before they become expensive disputes. Whether reviewing employment policies and restrictive covenant agreements, auditing IP protections, or stress-testing commercial contracts, Andres helps clients build the kind of legal foundation that makes them harder to sue and better positioned if litigation comes anyway.

A Litigator Built Differently.  Andres’s path to Romano Law is anything but conventional – and that’s precisely what makes him effective.  He began his career at Fitzpatrick, Cella, Harper & Scinto (now part of Venable LLP), a premier intellectual property litigation boutique, where he developed a deep foundation in IP disputes.  He then served as an Assistant District Attorney in Queens County, investigating and prosecuting hundreds of felony cases – many through trial.  He returned to private practice at BakerHostetler LLP, one of the country’s leading national firms, before ultimately choosing to trade Big Law for something different: running his own coffee roasting company.

That entrepreneurial detour gave Andres something most litigators never get – firsthand experience as a business owner navigating the exact pressures his clients face.  He returned to practice with a client-side lens that shapes how he assesses risk, prioritizes strategy, and communicates with people who have real businesses on the line.

Andres practices in federal and state courts in New York and Florida, and works primarily with media, technology, creator, and financial services companies.

Selected Results:

  • Enforced trademark rights for a major cryptocurrency exchange against an infringer using a confusingly similar mark, resulting in full cessation of the infringing use.
  • Defended a media company against trademark infringement and false designation of origin claims, securing a favorable settlement that allowed the client to continue operations uninterrupted.
  • Won dismissal of trade secret and breach of confidentiality claims against a pharmaceutical company on a motion to dismiss — before a single document was produced in discovery.
  • Obtained full settlement value for an LLC member in a breach of purchase agreement action after key evidence surfaced during discovery.
  • Secured dismissal of a breach of contract claim by proving both the contract and the personal guaranty at issue were forged by a third party.
  • Successfully defended a media company CEO in arbitration against a former business partner asserting breach of operating agreement and fiduciary duty claims.
  • Obtained a favorable settlement for a startup tech company facing state securities and fraud claims from investors following a multi-million-dollar capital raise.
