Influencer Contracts: What Creators Should Look For Before Signing

Landing a brand deal is exciting. Signing the contract without understanding it can be costly.

Many influencer agreements go far beyond payment. They often include provisions affecting ownership of your content, how your name and likeness may be used, exclusivity, liability, and even artificial intelligence.

While every agreement is different, here are a few areas that deserve careful attention before you sign.

Understand What You’re Agreeing to Create

A contract should clearly describe your responsibilities. Unclear deliverables can lead to disagreements about what was promised or whether additional work is required.

Look Beyond the Compensation

Payment is important, but so are the terms surrounding when you’ll be paid, whether additional approvals are required, and what happens if the campaign changes or ends early.

Pay Attention to Content Rights

One of the most significant provisions in an influencer agreement addresses how your content may be used after it’s created.

Some brands request limited marketing rights. Others seek much broader rights that may allow them to continue using your content long after the campaign ends. Understanding those rights is essential before agreeing to them.

Consider Exclusivity

Some agreements restrict creators from working with competing brands for a period of time. Depending on the language, these provisions can affect future sponsorship opportunities.

Review AI and Digital Likeness Provisions

Many newer agreements include language addressing artificial intelligence. These provisions may involve the use of your image, voice, or other digital assets in ways that were uncommon only a few years ago.

Because this area of law is rapidly evolving, these clauses deserve careful review.

Know How the Relationship Can End

Every contract should explain what happens if either party wants to terminate the agreement, if deadlines change, or if unexpected circumstances interrupt the campaign.

Don’t Assume Standard Language Is Harmless

Many contracts contain legal provisions that receive little attention until a dispute arises. Governing law, dispute resolution, confidentiality, indemnification, and limitation of liability clauses can all affect your rights if problems develop.

Every Influencer Agreement Is Different

No two brand partnerships are exactly alike. A provision that makes sense for one campaign may be inappropriate for another. The value of a contract often lies not only in what it says, but also in what it leaves unsaid.

Having an attorney review an agreement before signing can help identify potential issues, clarify obligations, and ensure the contract reflects the deal you actually negotiated.
